Clavaa Privacy Notice

Welcome, and thank you for your interest in Clavaa LLC (“Clavaa,” “we,” “our,” or “us”). At Clavaa, we’re dedicated to creating a payment experience that benefits both consumers and merchants alike. We place a high priority on the privacy of our customers and visitors to our websites. This Privacy Notice explains how Clavaa collects, uses, and discloses information that identifies or makes you identifiable (“personal information”).
This Privacy Notice applies to information collected through Clavaa’s websites, including www.clavaa.com, and any other websites we own and operate that link to this Privacy Notice (collectively, the “Sites”). It also covers information collected through the Clavaa mobile application (the “App”), as well as through all related online, mobile-enabled, and/or digital services (including browser extensions and widgets) provided in connection with the Sites, the App, or as part of our payment services offered through authorized merchant websites (collectively, the “Service”).

1. HOW CLAVAA COLLECTS AND USES YOUR INFORMATION

We collect personal information in connection with your visits to and use of the Service. This includes information you provide directly, information from third parties, and information that is automatically collected, such as through cookies and other tracking technologies.
Information You Provide to Clavaa
We collect personal information directly from you in several ways. Categories of information we collect include:
Account Creation and Profile Information. When you register for an account, we collect personal information such as your name, email address, phone number, and shipping and billing addresses. You may also provide optional details, such as your birthday (day and month). Once registered, you can update your profile information, including your name, phone number, and email address, and link or unlink your bank account or debit card from your Clavaa account. This information helps us manage your account, provide relevant services (such as tracking store credits earned from purchases), communicate with you about your account or the Service, and support customer service needs.
Financial Information. To make purchases through authorized Merchants, you’ll need to connect a U.S. state or federally chartered bank account or debit card (“Payment Method”) to your Clavaa account.
Bank Account Information. When you choose to link your bank account, we use a third-party verification provider, such as Plaid Inc. (“Plaid”) or Teller, Inc. (“Teller”), to connect your bank account, verify it, and confirm your balance before authorizing a transaction. This financial information is shared directly with the third-party provider and processed in accordance with their Privacy Policy. In some cases, the data may also be shared with a payment processor to complete your purchase. For instance, Plaid may act as a payment processor for Clavaa. If direct connection to your bank is unavailable, the provider may ask for manual verification by placing a small micro-deposit (typically up to $1) in your account to verify ownership, which will then be deducted.
Communications. If you contact us through any paper or electronic means, we may collect your name, email, mailing address, phone number, and the contents of your communication. This can also include professional information about you and your company if you’re a business representative, such as when requesting a demo or case study. We use this information to respond to your inquiries, communicate with you, improve our Service, and manage and grow Clavaa.
Marketing Emails. We may use your email address, interests, and communication preferences to send you updates on the Service, as well as information on products and services we think may be of interest. If you’d like to stop receiving promotional messages, please follow the instructions in those messages and refer to the “Control Over Your Information” section below.
Employment Application Information. If you apply for employment with Clavaa, we collect contact details, demographic information, education, and work history, along with any other information you provide during the hiring process.
Business Contact Information. If you represent a business, we collect your information as needed for agreements or potential agreements with Clavaa. This may include your name, company contact information (such as email, phone number, and address), job title, and any other details relevant to the agreement. If you create a merchant account with us, we may also collect your username and password.
Cookies and Other Tracking Technologies to Collect Information
Clavaa and our third-party partners automatically collect certain information about you and your interactions with the Service when you visit our website, use our browser extensions or widgets, open our emails, or otherwise engage with us. This information is typically gathered through various tracking technologies, including:
Cookies, which are small data files stored on your device; and
Other technologies such as web beacons, pixels, embedded scripts, mobile SDKs, location-identifying technologies, and logging technologies (collectively, “tracking technologies”).
We may use third-party providers or tools to facilitate this collection. The information gathered may be combined with personal information we collect directly from you or from other sources.
Clavaa and our third-party partners may use tracking technologies to automatically collect information such as:
Device and Usage Information. This includes data about the computer, tablet, smartphone, or other device you use, such as your IP address, browser type, internet service provider, device type/model/manufacturer, operating system, date and time stamp, and a unique ID (like a persistent device identifier or Ad ID) that helps us identify your browser, mobile device, or Clavaa account across different devices. We may also work with third-party partners to use statistical modeling tools that allow us to recognize and contact you across multiple devices.
Mobile Device Information. When you access our Sites or App from a mobile device, we may collect unique identifiers linked to your device, such as UDID, mobile carrier, device type, model and manufacturer, and mobile operating system. Depending on your settings, we may also collect location data or approximate your location based on your IP address.
Access and Usage Information. This includes data on how you navigate our Service, such as the site from which you arrived, the site you visit after leaving, pages visited within the Service, frequency of access, actions taken (such as clicking links or watching videos), and whether you access the Service across multiple devices. We also collect information on your engagement with our emails, such as whether they were opened or links were clicked.
Interaction Information. We may record your interactions with the Service, including mouse movements, scrolling, clicks, keystrokes, browsing, search, and purchase behaviors. This may involve third-party tools to capture data on your interactions or input on the Service, including chat features.
Location Information. We or our third-party partners may derive general location data from your IP address to offer localized content and services.
Analytics Information. We may collect analytics data or use third-party analytics tools like Google Analytics to measure traffic, usage trends, and understand more about the demographics of our users. Browser Tokens. We may generate and maintain tokens in your browser’s local storage to create a more personalized experience. For example, we may use these tokens to identify and display any credits you have available to redeem.
Advertising and Partner Tracking. We also use tracking technologies when you engage with our features on partner and affiliate sites, such as advertising services or Clavaa features that appear on third-party sites. Data collected may include pixel-specific data like Pixel and Cookie IDs, button click data, and form entries related to signing up for our services. This information supports our business activities, such as facilitating transactions and providing customized services.
If you browse affiliate merchants’ websites through the Clavaa App, we may automatically collect details about your browsing and shopping activities, such as the merchants you visit, products you search for, view, or click on, items you add to your cart, and purchase confirmation data, including the product type and order total. When you make a purchase on an affiliate merchant’s site, we may connect your order total to a unique identifier to calculate any rewards or credits you’ve earned.
Purpose of Information Collected Automatically
The information collected through these tools enables Clavaa to enhance your experience by personalizing content, improving our Sites and Service, and increasing the effectiveness of our communications, offers, and customer service. Specifically, we may use tracking data to:
Remember information so you don’t have to re-enter it each time you visit;
Provide customized, personalized content and advertising;
Identify you across multiple devices;
Monitor and improve the effectiveness of our services;
Track aggregate metrics, such as total number of visitors, traffic patterns, usage trends, and demographic details on the Service;
Diagnose or fix technical issues;
Provide customer support;
Train and refine AI-driven tools; and
Plan for and improve our services.

Other Uses of Personal Information
In addition to the specific uses detailed above, Clavaa may collect and use personal information for the following purposes:
Business Operations. To operate the Service and provide you with its features and functionality, including any automated tools or features that utilize AI (such as generative AI).
Communication. To communicate with you through email, text message, or social media, and respond to your inquiries. This includes responding to questions, notifying you about Service updates, and addressing account-related matters.
Technical and Security Notifications. To send technical alerts, security notifications (including SMS text codes for verification), and other support or administrative messages.
Marketing and Advertising. To inform you about products, services, or updates through email, social media, or text message that we think may interest you. Please note that while we may use your personal information in this way, we do not use User Content (such as messages, reviews, or other communications) to serve ads, nor will we share User Content with third parties for marketing purposes, unless you have explicitly submitted it for that purpose.
Analytics and Research. For analytical purposes, to understand how users interact with the Service and to improve its functionality.
Product Development. To identify and facilitate potential improvements or future products, including training and refining automated tools that use AI.
Enforcement and Compliance. To enforce our Terms of Service, resolve disputes, meet legal obligations, and protect our interests and those of third parties.
Legal Compliance. To fulfill legal obligations and requirements.
Other Purposes. To fulfill any other purpose for which you provide personal information or for any lawful purpose to which you consent.

2. HOW CLAVAA SHARES YOUR INFORMATION

We may share your personal information as described below. For further information on controlling your information, see Control Over Your Information.
With Other Members of the Service for Shared Store Credits or Referrals
When you share store credits with others, the recipient will see your first name on their store credit transaction activity page (e.g., “claimed store credit from Jane D.”). Similarly, when a store credit you gifted is claimed, your transaction activity page will reflect the first name and initial of the last name of the recipient. This information is visible only to account holders as part of the store credit activity and is not visible to third parties. If you are referred to Clavaa by another user and make your first purchase through the Service, we may notify the person who referred you and share your first name and last initial with them.
With Our Service Providers for Business Purposes
We share personal information with third-party service providers who perform functions on our behalf, under reasonable confidentiality terms. These may include payment processors, web hosting providers, technology support providers, email communication providers, analytics services, data storage providers, and other service providers who help operate the Service.
With Authorized Merchants
We may share personal information with authorized Merchants for transactional and marketing purposes, including promoting their products or services. For example, we may provide an authorized Merchant you purchased from with details such as the owner of the store credit, contact information, credit amount, expiration date, and issue date. Merchants are responsible for managing your information in accordance with their privacy policies.
With Third Parties for Product Improvements
To assist in product development and improvement (including training automated tools using AI), we may share personal information with third-party vendors and select business partners.
With Business Partners
We may share personal information with business partners or allow them to collect information in cases where we jointly offer products or services. In such cases, both Clavaa’s and the partner’s names will appear, and the partner will use your information for their own purposes, including to inform you about their products or services.
Within Clavaa
We may share personal information within Clavaa and with other companies under common ownership or control. These companies will use your personal information as described in this Privacy Notice.
In the Event of a Corporate Transaction
If Clavaa undergoes a corporate transaction, such as a sale or transfer of assets, merger, acquisition, bankruptcy, or reorganization, personal information may be transferred. We will make reasonable efforts to ensure that any transferred information is treated according to this Privacy Notice.
When Required by Law
We may share your information with third parties if required by law, subpoena, or if we reasonably believe such action is necessary to:
Comply with legal obligations or requests from law enforcement;
Enforce our Terms of Service or other agreements, or protect the security or integrity of Clavaa’s services, prevent harm, prevent financial loss, or prevent fraud or illegal activity;
Exercise or protect the rights, property, or personal safety of Clavaa, our users, visitors, or others.
With Your Consent
We may disclose your information publicly or to third parties if you provide your prior consent.
In Aggregated or Anonymized Format
We may share your information in an aggregated or anonymized form that does not directly identify you as an individual.

3. THIRD-PARTY TRACKING AND ONLINE ADVERTISING

Clavaa may participate in interest-based advertising and work with third-party advertising companies to serve targeted ads based on your browsing history. We permit third-party ad networks, social media companies, and other third-party services to collect information about your usage of our Service over time, allowing them to display ads on our Service, on other websites or services you may use, and across multiple devices. Typically, this information is collected through tracking technologies such as cookies, web beacons, embedded scripts, and location-identifying technologies, which recognize your device and gather data, including clickstream information, browser type, timestamps, Ad ID, and similar details. If your device settings allow, they may also collect location data through GPS, Wi-Fi, or other methods.
To facilitate identification across devices, Clavaa may share a common identifier (such as a hashed email address or user ID) with third-party advertising partners. We and our third-party partners use this information to enhance the relevance of the ads you see, and for services like reporting, attribution, analytics, and market research. We may also use third-party services (such as social media platforms) to serve targeted ads by sharing a hashed version of your email address or other identifiers with the platform provider.
We may engage in the following:
Social Media Platforms. Clavaa may display targeted ads through social media platforms, including Facebook, Twitter, and others. These platforms offer interest-based advertising programs that enable us to direct ads to users interested in our services while they are on the platform, or to similar user groups with shared demographics or interests. We may share a unique identifier, like a user ID or hashed email address, with these platforms or allow them to collect information from visitors to our website through a first-party pixel. This enables us to target you or a custom audience on the social media platform. These ads are governed by the privacy policies of the respective social media companies. If you prefer not to receive targeted ads on social media, you may be able to adjust your advertising preferences in your account settings on those networks.
Third-Party Partners. Clavaa collaborates with various third-party partners to provide advertising services. For example, we use Google Analytics to identify and link the devices you use when you access our Service through a browser or mobile device, log in to your account, or interact with Clavaa. We may share a unique identifier, such as a user ID or hashed email address, with Google to enable this service. Google Analytics helps us better understand user interactions with our Service and tailor our ads and content accordingly. Display Advertising and Advanced Features. Clavaa may also use certain display advertising options and advanced features through Google Analytics. These allow us to combine first-party cookies (like the Google Analytics cookie) with third-party cookies (such as the DoubleClick advertising cookie) to display ads based on past interactions with the Service. To control your advertising preferences or opt out of Google advertising products, you can visit the Google Ads Preferences Manager at https://google.com/ads/preferences or explore the NAI’s resources at http://www.networkadvertising.org/choices.

4. CONTROL OVER YOUR INFORMATION

Email Communications. From time to time, Clavaa may send emails about updates to the Service, products, or services, and promotional offers from us or third parties that may interest you. If you wish to unsubscribe, click the “unsubscribe” link at the bottom of the email. Note that certain service-related emails (e.g., account verification, transaction confirmations, and technical/legal notices) cannot be unsubscribed from.
SMS Text Messaging. If you opted into Clavaa’s SMS text messaging program, you may opt out of promotional SMS texts at any time. However, opting out of promotional messages does not stop transactional messages related to your account or services (e.g., security verification codes). To unsubscribe, reply STOP to any promotional text. For assistance, contact us at help@clavaa.com.
Modifying Account Information  If you have an account with us, you can update certain information (e.g., contact details) by logging in and visiting the “account settings” page. You can also link or unlink your bank account. Note that unlinking your bank account from Clavaa does not unlink it from third-party providers like Plaid or Teller; you must follow their respective policies for complete removal. For requests to access, correct, or delete other personal information, please email us. We may ask for additional verification and may not fulfill all requests in every circumstance.
Closing or Deleting Your Account. To close your account and delete your information, email us at help@clavaa.com. Please note that we may retain certain information as required or permitted by law. If you have outstanding balances, your account cannot be closed until they are resolved. Additionally, accounts with third-party providers like Plaid or Teller will remain open and must be managed directly with those companies.
Cookies and Other Tracking Technologies Opt-Out. Depending on your browser or device, you may be able to manage cookies and tracking technologies through your settings. Options may include: (i) setting notifications for cookies, (ii) disabling existing cookies, or (iii) configuring automatic cookie rejection. Note that some features on our site may not function properly if cookies are disabled. Mobile device users may not have full control over cookies. To remove a stored token, you can clear your browser cache.
Interest-Based Advertising. For more information on interest-based advertising and to opt out, visit the Digital Advertising Alliance’s (DAA) resources or the Network Advertising Initiative’s (NAI) online resources. You may also opt out of mobile app ads by visiting http://www.aboutads.info/appchoices or adjusting ad tracking preferences on iOS and Android devices. Opting out of interest-based advertising does not mean you will no longer see ads; it only means that ads from DAA participants may no longer be based on your interests. We are not responsible for third-party opt-out programs.
Google Analytics and Advertising. To control advertising preferences or opt-out of certain Google advertising products, visit the Google Ads Preferences Manager or the NAI’s resources.
Push Notification Preferences. To stop receiving push notifications, adjust your settings in the iOS or Android notifications menu.
Access to Your Device Information. You can manage Clavaa’s access to your device in the “Settings” app on your device.

5. How Clavaa Retains and Protects Your Information

Clavaa will retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Notice, unless a longer retention period is required or permitted by law. Data is stored on servers located in the United States or in other countries where Clavaa, its affiliates, subsidiaries, agents, or contractors maintain facilities. If you reside in the European Union or other regions with laws governing data collection and use that differ from U.S. law, please be aware that your personal information may be transferred to jurisdictions without the same data protection laws as your own.
Clavaa takes the security of your information seriously and implements commercially reasonable physical, technical, and organizational measures to protect the integrity and security of all collected data. However, no system is completely secure, and we cannot guarantee 100% security of our systems. In the event of a security breach affecting your information, Clavaa will take appropriate steps to investigate, notify affected individuals as required by law, and implement any necessary measures to address the situation.

6. Links to Third-Party Websites and Services

For your convenience, Clavaa’s Service may include links to third-party websites or services that we do not own or operate. We are not responsible for the privacy practices, information, or content of these linked sites or services. Your interactions with third-party websites or services are governed by their own privacy policies and terms, not ours. Using third-party sites or services is at your own risk, and we encourage you to review their privacy policies before sharing any personal information.

7. Children’s Privacy

Clavaa’s services are not intended for children under 18. We do not knowingly collect or solicit personal information from children under 18. If we discover that we have inadvertently collected personal information from a child under 18, we will promptly delete it. If you believe we may have collected information from a child under 18, please contact us at help@clavaa.com.


8. Region-Specific Disclosures

California – Your California Privacy Rights: California residents may request information regarding the disclosure of personal information to third parties for their direct marketing purposes for the previous calendar year, in accordance with California Civil Code Section 1798.83. To opt out of sharing in this manner, please email us at help@clavaa.com.
Nevada: Chapter 603A of the Nevada Revised Statutes allows Nevada residents to opt out of future sales of certain information collected or to be collected by a website operator. To submit a request, please contact us at help@clavaa.com.

9. Changes to Privacy Notice

Clavaa may update this Privacy Notice from time to time at our discretion. If material changes are made, we will notify you via the primary email linked to your Clavaa account or by placing a prominent notice on our website. It is your responsibility to review this Privacy Notice periodically. When updates are made, we will revise the “last updated” date accordingly.
